What are Property Rights?

Property rights are titles for owning and controlling resources, including land and buildings, and other forms of tangible and intangible assets. Such rights are important because they place the owner in a position where they have the opportunity to use, transfer, and benefit from their property. Property rights in India have evolved through various historical, social, and economic changes.

Traditionally, property rights have been influenced by customary law, British colonial law, and post-independence legislation. This is demonstrated in the debates of the Constituent Assembly with regard to protection of private property coupled with a need for social and economic justice.

Constitutional View on Property Rights

Under Article 19(1)(f) and Article 31 of the original Constitution of India, the right to property was a fundamental right. The 44th Amendment in 1978 marked a change by reducing the right to property as a constitutional right under Article 300A, signifying an apparent change in the approach of the state towards property, which has the potential for intervention on grounds of public welfare but still stands at safeguarding individual property against arbitrary deprivation.

Article 39 of the DPSP attempts to direct the state towards such policies that distribute material resources to subserve the common good. Although DPSPs are not justiciable by courts, it forms a source of constitutional guidance in formulating laws and policies.

The judgment now joins the long list of judicial pronouncements and interpretations spanning decades surrounding Article 39(b) in respect of how much private property the state may commandeer to redistribute. The majority opinion came to this view on the basis that Justice Iyer's expansive interpretation supported a variant of economic policy where state acquisition of private property was promoted as a distinct approach—a notion not necessarily preserved in the text of the constitution.

Supreme Court Ruling on the Case

Laws and policies require to outline which personal resources can be used for public purposes under Article 39(b) of the Constitution while ensuring judicial guidelines set by this judgment.

It would also be essential for the government to make stronger legal frameworks safeguarding private property rights while still allowing the state to acquire property for authentic public purposes with just compensation. This would demand fair and clear expropriation procedures and criteria that make sure the state actions are just and fair.

There is a need to further strengthen public awareness and awareness of property rights. Citizens have a right to know their constitutional rights and existing legal protections against arbitrary actions on the part of the state in order to assert democratic values.
