- రాజ్యాంగంలోని ఆర్టికల్ 169 ఆ మేరకు రాష్ట్ర శాసనసభ తీర్మానాన్ని ఆమోదించినట్లయితే , ఒక రాష్ట్రంలో శాసన మండలిని సృష్టించడానికి లేదా రద్దు చేయడానికి పార్లమెంటును అనుమతిస్తుంది.
- అటువంటి కౌన్సిల్ ఉన్న రాష్ట్ర శాసన మండలిలో మొత్తం సభ్యుల సంఖ్య ఆ రాష్ట్ర శాసనసభలోని మొత్తం సభ్యుల సంఖ్యలో మూడింట ఒక వంతుకు మించకూడదు .
